Shanghai Provident Fund Management Center initiated a municipality-wide law enforcement inspection of units' provident fund payment in April as per Notice on Launching of Law Enforcement inspection of Housing Provident Fund Payment in the Municipality (SHGJJG No. 4 [2013]) . Nonconformities were identified during inspection of few units' provident fund payment, such as failure to go through HPF payment registration formalities, failure to fulfill HPF employee account opening formalities, and failure to make full HPF payment in a timely manner for the entire staff.
To safeguard employees' legitimate rights and interests, we herein issue this notice as follows for all units to step up efforts to proceed with law enforcement inspection of provident fund payment and act accordingly.
1. Each unit is obliged to make HPF payment as per the regulations to proactively safeguard employees' legitimate rights and interests, and report any identified HPF payment nonconformities to the corresponding district/county provident fund management division and take subsequent remedial actions for correction.
2. Those units that have failed to go through HPF payment registration or HPF employee account opening formalities should go to the corresponding district/county provident fund management division for fulfillment of the formalities as soon as possible. Those units that have failed to make due or full provident fund payment should go through paying arrears formalities or draw up a remedial plan as required. Those units that have encountered difficulties in making HPF payment may apply for reduced rate or prolonged payment pursuant to relevant regulations.
3. Shanghai Provident Fund Management Center shall be poised to enhance law enforcement inspection of units' HPF payment, supervising and monitoring nonconforming units' implementation of remedial plans within the prescribed timeline. Those nonconforming units that refuse to take corrective actions shall be closely monitored or even penalized in accordance with Regulations on Management of Housing Provident Fund, Provisions of Shanghai Municipality on Administration of Housing Provident Fund, and Measures on Management of Shanghai Provident Fund Administrative Enforcement.
4. As for those nonconforming units that have failed to go through HPF payment registration or HPF employee account opening formalities, or failed to make due and full HPF payment, Shanghai Provident Fund Management Center, apart from inflicting penalties pursuant to relevant regulations, shall also publicize them on Shanghai Provident Fund Website, and provide relevant violation information to Shanghai public credit information service platform, and apply to the people's court for putting them under bad-credit name list pending administrative enforcement.
